Abstract
Kata Kunci: Poligami, Maqāṣid Al-Qur`ān, Abū Ḥāmid Al-Gazāli, Ḥannān Laḥḥām. Keretakan keluarga poligami merupakan salah satu faktor kenapa poligami dipersoalkan. Ditambah lagi ketidaksiapan laki-laki memberikan keadilan kepada anggota keluarga poligami. Padahal keadilan merupakan syarat utama yang harus dipenuhi jika ingin berpoligami. Karena sulitnya keadilan dalam berpoligami kemudian Al-Qur’an memberikan batasan-batasan yang mencegah terjadinya kezaliman terutama terhadap perempuan sebagai anggota keluarga yang dipoligami. Kondisi tersebut menjadikan poligami diperbincangkan sampai menimbulkan pro-kontra di antara beberapa pihak, sehingga poligami selalu hangat untuk diteliti apalagi jika didasarkan pada praktik poligami yang sangat jauh dari prinsip-prinsip yang diajarkan Al-Qur’an. Hal ini yang kemudian memotivasi penulis mengkaji konsep poligami dalam Al-Qur’an. Untuk menjawab masalah tersebut maka terdapat tiga fokus penelitian dalam tesis ini, yaitu apa saja ayat-ayat poligami dalam Al-Qur’an? Bagaimana maqāṣid al-qur’ān dalam ayat-ayat poligami perspektif Abū Ḥāmid Al-Gazālī dan Ḥannān Laḥḥām? Bagaimana prinsip-prinsip dalam berpoligami menurut maqāṣid al-qur’ān Abū Ḥāmid Al-Gazālī dan Ḥannān Laḥḥām? Untuk menjawab fokus penelitian tersebut dilakukan penelitian pustaka dengan jenis kajian tematik konseptual menggunakan perspektif maqāṣid al-qur’ān. Temuan penelitian ini: pertama secara implisit pembahasan tentang poligami terdapat di dalam lima ayat Al-Qur’an. Berdasarkan asbabunnuzulnya ayat-ayat tersebut adalah QS. Āli-‘Imrān: 14, QS. Al-Aḥzāb: 51, QS. An-Nisā’: 3, 128-129. Kedua dalam perspektif Maqāṣid Al-Qur’ān ayat-ayat poligami Abū Ḥāmid Al-Gazālī menyimpulkan bahwa aturan poligami yang disampaikan dalam Al-Qur’an bertujuan untuk al-mugniyah al-mutimmah yaitu ketetapan hukum syari’at yang diatur dalam jalan Allah Swt., agar manusia mencapai maqāṣid tertinggi (al-uṣūl al-muhimmah) yaitu mengenal Allah Swt. Adapun maqāṣid alqur’ān ayat-ayat poligami Ḥannān Laḥḥām menyimpulkan bahwa ketetapan yang berkaitan dengan kehidupan manusia termasuk tentang pernikahan poligami bertujuan untuk maqāṣid ad-dīn yaitu terciptanya maṣālih al-fard (kemaslahatan individu) dan maṣālih al-ummah (kemaslahatan umat). Kemaslahatan manusia menurut Ḥannān Laḥḥām adalah inti dari maqāsid al-qur’ān. Ketiga prinsip-prinsip dalam berpoligami perspektif maqāṣid al-qur’ān Al-Gazālī dan Laḥḥām ada tiga yaitu a) bersikap adil; b) memahami kondisi sosial masyarakat; c) takut berbuat zalim dan dosa. Penelitian ini menegaskan bahwa Al-Qur’an telah memberikan batasan-batasan secara ketat terkait praktik poligami agar manusia tidak dengan mudah berbuat zalim di balik syariat poligami. ث عنوان الرسالة: "مفهوم تعدد الزوجات في القرآن: منظور مقاصد القرآن ألبي حامد الغزالي وحنان لحام" طيبة القمرية، 0202 ،رسالة ماجستير، قسم علوم القرآن والتفسير، البرنامج الدراسي للدراسات العليا )الماجستير(، الدراسات العليا بجامعة اإلسالمية الحكومية مادورا ، الرئيسي: الدكتور أحمد فوائد، الماجستير، والدكتورة فتري ألفيا حليدة، الليسانس، الماجستير الكالمي اإلسالمي. الكلمات الرئيسية: تعدد الزوجات، مقاصد القرآن، أبو حامد الغزالي، حنان لحام. تتضمن تصدع األسرة في تعدد الزوجات أحد العوامل التي تثير الجدل حول تعدد الزوجات. باإلضافة إلى عدم استعداد الرجال لتقديم العدالة ألفراد األسرة في تعدد الزوجات. فالعدالة هي الشرط األساسي الذي يجب تحقيقه إذا كانت النية هي تعدد الزوجات ا لصعوبة تحق ً . ونظر يق ً العدالة في تعدد الزوجات ا تمنع الظلم، خاصة ضد ، فإن القرآن يضع حدود النساء كأفراد في األسرة تعدد الزوجات. هذه الظروف تجعل تعدد الزوجات موضوع جدلي يثير الجدل بين األطراف المختلفة، لذلك يظل تعدد الزوجات ا للدراسة، خاصة إذا ما ا ً ا ساخن ً موضوع ستندت إلى ممارسات تعدد الزوجات ا عن مبادئ القرآن الكريم. وهذا ما يحفز الكتا ً التي تبتعدكثير ب على دراسة مفهوم تعدد الزوجات في القرآن الكريم. للرد على هذه المشكلة، هناك ثالثة محاور للبحث في هذه األطروحة، وهي: ما هي آيات تعدد الزوجات في القرآن الكريم؟ كيف تتضمن مقاصد القرآن في آيات تعدد الزوجات و جهة نظر ً أبو حامد الغزالي وحنان لحام؟ وما هي مبادئ تعدد الزوجات ا لمقاصد القرآن الكريم وجهة وفق نظر أبو حامد الغزالي وحنان لحام؟ للرد على هذه النقاط المركزية للبحث، تم إجراء دراسة أدبية من خالل نوع من الدراسات الثيماتية المفهومية باستخدام منظور مقاصد القرآن الكريم. تعدد الزوجات في خمس آيات قرآنية. نتائج هذا البحث: أو ، يوجد نقاش ضمني حول الً ا إلى أسباب نزول هذه اآليات، فإنها هي ً استناد سورة ال عمران: 42 ،األحزاب: 14 ،النساء: 3 ، ً، من منظور مقاصد القرآن، خلص أبو حامد الغزالي في آيات تعدد الزوجات ثانيا. 401-401 إلى أن قواعد تعدد الزوجات الموجودة في القرآن هدف إلى المغنية المتمة، أي تثبيت الشريعة التي ُحكم بها في سبيل الله تعالى، لكي يصل اإلنسان إلى أعلى مقاصد )األصول المهمة( وهي التعرفعلى الله تعالى. أما مقاصد القرآن في آيات تعدد الزوجات حسب حنان لحام، فخلص إلى أن القوانين المتعلقة بحياة اإلنسان، بما في ذلك تعدد الزوجات، تهدف إلى مقاصد الدين، أي تحقيق ا لحنان لحام هي جوهر مقاصد الق ً ً مصالح الفرد ومصالح األمة. مصلحة اإلنسان وفق رآن. ثال ، ثا ادالً المبادئ في تعدد الزوجات من منظور مقاصد القرآن للغزالي و لحام هي ثالثة: أ( أن يكون ع ، ً ب( أن يفهم حالة المجتمع االجتماعية، ج( يخشى أن يكون ظالم ا. يؤكد هذا البحث أن ا وإثم ً القرآن قد قدم حدود صارمة بشأن ممارسة تع ا دد الزوجات لكي ال يسهل على اإلنسان أن يظلم وراء شريعة تعدد الزوجات. ABSTRACT Toyyibatul Qomariyah, 2024, Concept of Polygamy in the Qur'an: Perspectives from the maqāṣid al-qur`ān of Abū Ḥāmid Al-Gazāli and Ḥannān Laḥḥām. This thesis is presented to fulfill the requirements of the Master's Program (S2) in the Department of Quranic Studies and Exegesis (IQT), Graduate Program at IAIN Madura. Supervisors: Dr. Ah. Fawaid, M.A. and Dr. Putri Alfia Halida, Lc., M.Th.I. Keywords: Polygamy, Maqāṣid Al-Qur`ān, Abū Ḥāmid Al-Gazāli, Ḥannān Laḥḥām. The cracks in polygamous families are one of the reasons why polygamy is questioned. Furthermore, the unpreparedness of men to provide justice to members of polygamous families exacerbates the situation. Yet, justice is a primary requirement that must be fulfilled if one wants to practice polygamy. Due to the difficulty in achieving justice in polygamy, the Qur’an then sets limits to prevent oppression, especially against women as members of polygamous families. Such conditions lead to discussions surrounding polygamy, often sparking pros and cons among various parties, making polygamy always a topic of scrutiny, especially if it is based on practices far from the principles taught by the Qur’an. This is what motivates the author to examine the concept of polygamy in the Qur’an. To address this issue, there are three research focuses in this thesis: what are the verses about polygamy in the Quran? How do the maqāṣid al-qur’ān manifest in the verses about polygamy from the perspectives of Abū Ḥāmid Al-Gazālī and Ḥannān Laḥḥām? What are the principles of polygamy according to the maqāṣid al-qur’ān of Abū Ḥāmid Al-Gazālī and Ḥannān Laḥḥām? To answer these research focuses, a literature review is conducted using a thematic conceptual study approach focusing on the perspective of maqāṣid al-qur’ān. These research findings are: first implicit discussions on polygamy are found in five Quranic verses, namely QS. Āli-‘Imrān: 14, QS. Al-Aḥzāb: 51, QS. An-Nisā’: 3, 128-129. Second maqāṣid al-qur’ān perspectives on polygamy according to Abū Ḥāmid Al-Gazālī, the polygamous rules in the Quran aim for "almugniyah al-mutimmah," the establishment of sharia law in the path of Allah, leading humans to achieve the highest objectives (al-uṣūl al-muhimmah), namely, recognizing Allah. As for maqāṣid al-qur’ān verses on polygamy, Ḥannān Laḥḥām considering the maqāṣid ad-dīn, concludes that regulations related to human life, including polygamous marriage, aim for "maṣālih al-fard" (individual benefits) and "maṣālih al-ummah" (community benefits). Human welfare, according to Ḥannān Laḥḥām, is the essence of maqāṣid al-qur’ān. Third principles of polygamy from the maqāṣid al-qur’ān perspective is three principles for polygamy from the perspective of maqāṣid al-qur’ān are identified, including: a) Maintaining justice, b) Understanding the social conditions of society, c) Fearing oppression and sin. This research emphasizes that the Qur'an has set strict limits regarding the practice of polygamy so that humans do not easily commit injustice behind the polygamy law.
